“The Myth of Lawyers I” – Providing services

Due to the nature of the work they do, and part of the work they perform, lawyers often identify with their clients, completely unfounded.

I. I will first deal with an example from the “most interesting area” – criminal law.

First of all, a lawyer deals with the professional representation of the rights of his clients, not their actions. Therefore, the lawyer does not try to justify the actions of any natural or legal person, nor does he present a defense in a subjective sense, that is, he tries to find justification for the actions of any person and thus prevent him from serving a prison sentence or some other punishment.

The point is that the lawyer must make sure that the rights of his client are protected to the greatest extent possible, and in this sense it is his duty to reduce or completely neutralize the punishment prescribed by law for a certain criminal offense.

Therefore, it is not the lawyer’s fault if someone accused of murder is acquitted, it is the state prosecutor’s fault that he failed to prove that the accused actually committed the murder!

II. Furthermore, the topic for which lawyers are “controversial” is definitely charging for the legal assistance and advice they provide.

 For the sake of clarification, lawyers charge for their services in accordance with the official Lawyer’s Tariff.

So, there are very rare cases when lawyers charge for their services in a higher amount than what the tariff prescribes, and for interested readers, the same is available on the website of the Bar Association of Montenegro, although I doubt that anyone is so curious as to find out the prices of legal aid.

With regard to the above point of view, there are very frequent cases of lawyers charging legal assistance to clients at a lower price, or not charging it at all, which is a paradox, since there is a rumor circulating in society that lawyers are unscrupulous. Education and personal experience are very important in every sphere, and so also when commenting on a profession like this.

So, if you need legal help, and you want to turn to someone who will protect your interests and rights in the best possible way, be prepared to hear the very high price at which those interests and rights are protected. However, if you are not ready to hire a lawyer at the high price prescribed by the Lawyer’s Tariff, you must accept the fact that your rights and interests may not be represented in the best possible way. By comparison, there’s a reason why Nike Shop and Secon hand Shop wardrobes don’t cost the same.
